HHOA RULES & REGULATIONS (Rev. Jan. 2003)
INTRODUCTION

     The Architectural Control Committee (ACC) has the authority, as noted in the Holleybrooke Covenants, to review any and all plans to construct any residence or improvements within this subdivision.  No construction of any residence or improvements can be legally commenced in this subdivision without the approval of the ACC.

     The Association's Board (or its designees) has the authority to supervise the exterior maintenance of all lots within this subdivision.  This is in accordance with the Covenants, By-Laws, and the Virginia Property Owners Association Act.

     The Association's Board has adopted the ACC Guidelines in conjunction with the Association's Rules and Regulations and County Codes for subdivisions within the county, in order to maintain and improve this subdivision.  The ACC Guidelines, the Association Rules and Regulations, and the Holleybrooke Covenants will be enforced by the Association's Board (or its designees) to the fullest extent permitted by law.

     It shall be the responsibility of the homeowner (whether residing within the home, or acting as the landlord) to fully comply with the ACC Guidelines, the Association Rules and Regulations, and the Holleybrooke Covenants to prevent the occurrence of any unclean or unsightly condition of structures on a lot that does (or would) decrease the attractiveness or value of any property in the Holleybrooke Subdivision (Article IV para 5 of the Master Covenants).

     Any questions concerning any subject within this page is to be addressed to the ACC Committee or the Association's Board (or its designees).


ACC REQUEST REQUIREMENTS

Before any improvements, renovations, or building commences on any lot, approval from the ACC must be requested.  Example of improvements, renovations, or building projects include but not limited to:
     1.  Any additions to a home, such as construction of a garage, carport, or deck.
     2.  Building may mean outbuildings (sheds) or fences.

How To Submit A Request
All requests must be submitted in writing and include the following:
     1.  Address and lot number (if known).
     2.  An overview of the project, including the dimension and type of material to be used.
     3.  If it involves a building (shed), indicate where it will be placed on the lot. If a plot of the lot is available, a copy should be submitted indicating where the building will be located. If a plot is unavailable, then a sketch of the lot showing the location will suffice.

CONSTRUCTION MATERIALS


The ACC has established guidelines for construction materials, home additions, outbuildings, decks and hot tubs, swimming pools, fences, flag poles, signs, satellite dishes, basketball poles, yard maintenance, trees, driveways, motor vehicles, recreational vehicles, boats, etc.

PROHIBITED ACTIVITIES

Provided below is an overview of the provisions of the Covenants as they apply to the ACC:

  • No structure shall be erected, altered, or permitted to remain on any Holleybrooke Subdivision Lot and/or Property (herein referred to as Lot) other than a single residence and private garage (the garage being for not more than three vehicles).
  • No lot shall be subdivided or its boundary lines changed.
  • No metal buildings are permitted as outbuildings on a Lot.
  • No aboveground pool shall be erected on any Lot.
  • No commercial builder of residences will be permitted to have a model home in the Subdivision unless they are actively building homes in Holleybrooke.
  • No livestock or poultry of any kind shall be raised, bred, or kept on any Lot.
  • Any signs to be displayed to public view on any Lot must meet the requirements of Article IV, Paragraph 2, of the Covenants.
  • No Lot shall be used or maintained as dumping ground for rubbish.
  • No vehicle shall be parked, permanently or temporarily, on any exterior area of the Lot other than on the primary driveway serving the residence.

VARIANCES AND REMEDIES

The ACC may make exceptions to, and grant variances from, the restrictions as set forth in the Covenants. All requests for variances and exceptions must be submitted to the ACC in writing, and must include the following information:

  • Details as to the specific reason why you are making the request.
  • All of the same information noted under How To Submit A Request in this page.
  • Any additional information that may be required for the specific project as outlined above.
  • Written approval from any other homeowner that may be affected by your requested variance or exception.

Please note that the ACC will carefully review any requests for a variance or exception to the Covenants. It is not the practice of the ACC to grant such requests unless required to do so by law (such as allowing for the placement of satellite dishes as detailed above also), or when it is considered to be in the best interest of not only the requesting homeowner, but of the Holleybrooke/Cobblestone Subdivision as a whole.

ENFORCEMENT AND REMEDIES

Whenever a violation or breach of the ACC Guidelines, the Association Rules and Regulations, or the Covenants is brought to the attention of a homeowner by the ACC or the Association's Board (or its designee), the homeowner has a period of 15 days from the date of receipt in which to remedy the violation or breach (unless a shorter or longer period is granted).

If the violation or breach is not remedied within the allowed time, the Association's Board shall have the power to levy charges against the member for the violation or breach and/or shall have the power to suspend membership privileges. The Association's Board (or its designee) shall give the member the opportunity to be heard and to be represented by counsel before the Association's Board of Directors prior to charges being assessed. The Association's Board (or its designee) can and will take the necessary legal action to remedy the violation or breach. If it becomes necessary for the Association (or its designee) to take legal action, the homeowner will be responsible for any and all cost(s) associated with the collection and/or charges.

IMPORTANT: If extenuating circumstances prevent the homeowner from remedying the violation or breach within 15 days, the homeowner must submit a written request to the ACC requesting an extension to the deadline. The request must be received by the ACC prior to the expiration of the original 15 day allotment. The extension may or may not be granted at the discretion of the ACC. In either case, the homeowner will immediately be notified of the determination.

The failure of the Holleybrooke Homeowners' Association to enforce any of the Covenants is not a justified reason for the continuation of any violation of the Covenants. This applies whether or not the ACC was in existence at the time the violation occurred. The Covenants shall remain in effect at all times, and may be enforced at any time at the discretion of the ACC and the Holleybrooke Homeowners' Association Board of Directors.

In the event of a violation or breach of any condition and/or restriction as set forth in the Covenants, the Holleybrooke Homeowners' Association (or any homeowner in good standing) shall have the right to proceed at law or in equity to compel any such violation or breach.
